MONITRIBE TERMS AND CONDITIONS
These Terms and Conditions ('MoniTribe Terms') govern the use of MoniTribe, a group funding feature available on the PocketMoni platform. By creating, joining, or participating in a MoniTribe, you agree to be bound by these MoniTribe Terms and the PocketMoni Terms and Conditions.
1. RELATIONSHIP WITH POCKETMONI TERMS
- These MoniTribe Terms shall be read and construed together with the General PocketMoni Terms and Conditions.
- Where any conflict arises between these MoniTribe Terms and the PocketMoni Terms, the PocketMoni Terms shall prevail except where the conflict relates solely to the operation, features, or use of MoniTribe, in which case these MoniTribe Terms shall prevail.
- Matters relating to wallet custody, user verification, transaction monitoring, regulatory compliance, platform security, suspension, and termination shall be governed exclusively by the PocketMoni Terms and applicable law or regulation.
2. SCOPE OF MONITRIBE
MoniTribe allows groups to voluntarily contribute funds collectively, whether for mandatory obligations such as dues and service charges, or voluntary goals like community projects, events, and emergency support. Funds are securely held and can only be accessed through approved disbursement processes, ensuring trust for all members.
MoniTribe is not:
- A personal savings product;
- An investment or wealth management product;
- A lending, credit, or interest-bearing product.
3. ELIGIBILITY
- Only verified PocketMoni users on Gold Tier or Silver Tier can participate in a MoniTribe.
- By participating, each Member confirms they possess the legal capacity to enter into binding agreements under applicable law.
- The platform reserves the right to refuse or restrict access where eligibility requirements are not met.
4. CREATION OF A MONITRIBE
A MoniTribe is created by a Creator who determines:
- Contribution structure (fixed or flexible);
- Contribution frequency (one-time or recurring);
- Start and end dates;
- Withdrawal approval method;
- Appointment of at least one Admin.
MoniTribe may operate for a maximum duration of one (1) year, subject to extension by the Creator/Admin. Once active, the Creator or Admin shall not make changes that materially prejudice the terms agreed by the Members except with prior written consent of the Members.
5. ROLES AND RESPONSIBILITIES
- The Creator: sets up and configures the MoniTribe, initiates withdrawal requests, and may extend or close the MoniTribe.
- Admins: manage Members, approve Disbursements where applicable, and do not have direct or unilateral access to MoniTribe funds.
- Members: contribute funds to the MoniTribe and view transaction history and activity.
- Approvers: are selected automatically where applicable or by the Creator; they approve or reject withdrawal requests per the configured approval process.
6. CONTRIBUTIONS / FUNDING
- All Contributions shall be made exclusively through the PocketMoni platform.
- Only Members of a MoniTribe may make Contributions to MoniTribe.
- Contributions cannot be withdrawn unless the objective is abandoned, the deadline is reached or as otherwise agreed; in such circumstances the Creator shall refund Contributors.
- When a Member leaves the MoniTribe, refundable amounts shall be proportionate to the percentage of their contribution that has not yet been spent within the MoniTribe.
7. CUSTODY AND SECURITY OF FUNDS
- All MoniTribe funds are held in a dedicated, restricted account within the PocketMoni Platform.
- No Creator, Admin, Member, or PocketMoni personnel may access MoniTribe funds directly.
- Funds may only be released through the approved Disbursement process.
8. DISBURSEMENTS
Disbursements may be initiated:
- Upon completion of Contributions;
- Upon achievement of the stated goal;
- Upon reaching the deadline;
- Manually by the Creator, where permitted.
All Disbursements are subject to the configured approval mechanism. PocketMoni reserves the right to delay, suspend, or decline any Disbursement where fraud, error, misuse, or regulatory concerns are reasonably suspected.
9. REFUNDS AND EXIT
- Refunds of Contributions may be initiated where a MoniTribe is cancelled or terminated; where the stated objective is abandoned; or where the applicable deadline has been reached and a refund is permitted under the MoniTribe&s configuration.
- Where a Member exits prior to completion, any refundable amount shall be limited to the percentage of the member&s contribution that has not been spent within the tribe.
- All refunds shall be processed exclusively to the exiting or eligible Member&s PocketMoni account; no refunds to third-party or external accounts.
- PocketMoni shall not be liable for delays or failures to process refunds where such issues arise from system checks, regulatory requirements, or circumstances beyond PocketMoni&s reasonable control.
- The Creator or Admin can initiate withdrawal as agreed by the tribe at any time during the contribution period or upon termination, completion or abandonment. Withdrawals can be made to PocketMoni and non-PocketMoni accounts as permitted.
10. TRANSPARENCY AND RECORDS
PocketMoni shall make available transaction records and Contribution activity relating to each MoniTribe, including payment status of individual Members, viewable by Creator, Administrators, Approvers, and Members. Records displayed on the platform shall, in the absence of manifest error, constitute prima facie evidence of the transactions and activities recorded therein. PocketMoni shall not be liable for reliance beyond intended functionality, except to the extent loss arises from PocketMoni&s willful misconduct or gross negligence.
11. CANCELLATION AND TERMINATION
- A MoniTribe may be cancelled or closed by the Creator or an Administrator at any time via the PocketMoni platform, subject to any applicable approval requirements.
- Upon cancellation or closure, all available funds shall be refunded to Members in accordance with the terms of MoniTribe.
- PocketMoni reserves the right, without prior notice, to suspend, restrict, or terminate any MoniTribe where these terms or the PocketMoni Terms have been breached, where the MoniTribe is used for illegal or prohibited activity, or where required to comply with law or regulatory directive. PocketMoni shall not be liable for loss arising from suspension or termination carried out in accordance with this Clause.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, PocketMoni shall not be liable for disputes among members, failure to achieve objectives, wrongful conduct by any party, or reliance on MoniTribe information. PocketMoni disclaims all warranties and shall not be liable for indirect or consequential damages, including loss of profits or data.
13. INDEMNITY
Each Member agrees to indemnify, defend, and hold harmless PocketMoni and its affiliates from any claims, losses, liabilities, or expenses arising from the Member&s use of MoniTribe, including contributions, approvals, withdrawals, breach of terms, disputes among members, or reliance on MoniTribe records.
14. DATA PROTECTION AND PRIVACY
- Personal data relating to Users shall be collected, processed, stored, and disclosed in accordance with Data Protection Laws and PocketMoni&s Privacy Policy.
- By creating, joining, or participating in a MoniTribe, Members consent to the collection, use, storage, processing, and sharing of their personal data for operating and administering MoniTribe, meeting legal and regulatory obligations, and ensuring the security and functionality of the platform.
- Members retain rights under Data Protection Laws, including access, rectification, erasure, restriction of processing, portability, and objection, subject to legal and retention requirements.
- PocketMoni shall implement appropriate technical and organisational measures to safeguard personal data.
15. AMENDMENTS
PocketMoni may amend these MoniTribe Terms from time to time. Continued use of MoniTribe constitutes acceptance of the amended terms.
16. GOVERNING LAW AND DISPUTE RESOLUTION
These MoniTribe Terms shall be governed by the laws of the Federal Republic of Nigeria. Any dispute shall be resolved in accordance with the dispute resolution provisions set out in the PocketMoni Terms.
17. FORCE MAJEURE
PocketMoni shall not be liable for failure or delay caused by events beyond its control, including but not limited to regulatory actions, system failures, cyber incidents, technical glitches, or other force majeure events.
18. ACCEPTANCE OF TERMS AND CONDITIONS
By creating or joining MoniTribe, the Member acknowledges that they have read, understood, and agreed to these MoniTribe Terms and the PocketMoni Terms as may be amended from time to time.
